Legal Pathways for Cubans, Haitians, Nicaraguans, and Venezuelans: Humanitarian Parole and Asylum Processes

The U.S. government has introduced processes aimed at facilitating legal immigration pathways for individuals from Cuba, Haiti, Nicaragua, and Venezuela. These processes have been designed to address the humanitarian needs and the irregular migration challenges of individuals from these nations. Here’s an overview of the key processes:

1. Humanitarian Parole Process

In January 2023, the U.S. introduced a humanitarian parole program for nationals from Cuba, Haiti, Nicaragua, and Venezuela. The purpose of this program is to provide temporary legal status to those facing hardship, allowing them to enter the U.S. for up to two years on a case-by-case basis.

Eligible individuals need to have a sponsor in the U.S. who commits to supporting them financially during their stay.

Those granted humanitarian parole can apply for work authorization but must undergo security and public health screenings before entering the U.S.

2. Eligibility Criteria

Applicants must be nationals of Cuba, Haiti, Nicaragua, or Venezuela.
They must be outside the U.S. at the time of application.
Applicants must have a valid passport and a U.S.-based sponsor (either a family member, friend, or organization).

Ineligibility applies to those who have been deported or entered the U.S., Mexico, or Panama irregularly after specific dates (generally January or October 2022, depending on nationality).

3. Sponsorship Requirements

Sponsors must provide evidence of their financial ability to support the beneficiaries.
They are required to submit Form I-134A, which details their income, assets, and other resources.
Sponsorship ensures that the individuals entering the U.S. will not rely on public benefits or become a financial burden on the state.

4. Asylum and Refugee Processes

Individuals from these countries can also apply for asylum if they face persecution based on race, religion, nationality, political opinion, or membership in a particular social group.

Refugees may apply for resettlement through international programs if they are outside their home country and meet the eligibility criteria for refugee status.

5. Expedited Removal and Border Control Measures

The Biden administration has also implemented border control measures to deter irregular migration, including the rapid expulsion of individuals who attempt to cross the border illegally.
Those expelled under Title 42 or who attempt to enter without authorization may be barred from future legal immigration pathways.

6. Additional Support for Legal Pathways

The U.S. has increased resources to U.S. Citizenship and Immigration Services (USCIS) and other agencies to facilitate processing times for parole applications and expedite humanitarian relief requests.

This framework provides temporary protection for individuals from these four countries, allowing them to live and work in the U.S. legally while addressing the challenges faced by these migrants at home. It also reflects a broader policy shift to manage migration through legal channels while imposing restrictions on unauthorized crossings.

You must be located inside the United States to file Form I-134A. A beneficiary may not file Form I-134A on their own behalf.

Provided in the Form I-134A to ensure that you are able to financially support the beneficiaries you are agreeing to support.
